1. Acceptance of Terms

By accessing or using Verashot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Verashot. We may update these Terms from time to time; continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

2. Description of Service

Verashot is an AI-powered professional headshot generation platform. You upload portrait photos, and our system trains a custom AI model on your likeness to generate professional headshots in various styles and settings.

The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. Eligibility

You must be at least 18 years old to use Verashot. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

You may only upload photos of yourself or individuals for whom you have explicit written consent to submit their likeness for AI processing.

4. User Accounts

Access to the Service requires signing in with a Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at support@verashot.net if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to use the Service to:

  • Upload photos of other individuals without their explicit consent
  • Generate or distribute content that is illegal, defamatory, or harassing
  • Impersonate any person or entity
  • Create deepfakes or non-consensual intimate imagery
  • Attempt to reverse-engineer, scrape, or abuse the Service's infrastructure
  • Circumvent any access controls or rate limits
  • Use the Service for any purpose that violates applicable law

6. Photo Uploads and AI Processing

By uploading photos to Verashot, you grant us a limited, non-exclusive license to store, process, and transmit those photos solely for the purpose of generating your headshots. Your photos are sent to Replicate's API for AI model training and image inference.

You retain full ownership of photos you upload. Verashot does not claim any ownership rights over your uploaded images.

You represent and warrant that you own or have the necessary rights to all photos you upload, and that those photos do not infringe any third-party intellectual property, privacy, or publicity rights.

7. Generated Headshots

Upon payment and successful generation, you are granted a perpetual, worldwide, non-exclusive license to use the generated headshots for personal and commercial purposes, including professional profiles, marketing materials, and publications.

AI-generated images may occasionally contain artifacts or imperfections inherent to the technology. Verashot does not guarantee that all generated headshots will meet your expectations, and results may vary based on the quality and variety of photos you upload.

8. Payments and Refunds

Pricing

All prices are listed in USD and are subject to change without notice. Applicable taxes may be added at checkout depending on your location.

Payment processing

Payments are processed securely by Stripe. Verashot does not store your payment card details. By completing a purchase, you agree to Stripe's Terms of Service .

Refund policy

Due to the computational cost of AI model training, all sales are final once the training pipeline has been initiated. If you experience a technical failure on our end before training begins, contact us at support@verashot.net and we will review your case on a per-incident basis.

9. Intellectual Property

All trademarks, logos, software, and content comprising the Verashot platform (excluding user-uploaded photos and generated outputs) are owned by or licensed to Verashot and are protected by applicable intellectual property laws.

You may not copy, reproduce, or distribute any part of the Service without our prior written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. VERASHOT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERASHOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO VERASHOT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Verashot and its affiliates from and against any claims, liabilities, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as mutually agreed. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

14. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or an in-app notification. The effective date at the top of this page will be updated accordingly. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
